Terms of Service

1. Purpose

These terms govern the use of the Gradeon mobile app, published by L. Cerny, an independent developer ("we").

By creating an account or using the app, you accept these terms. If you do not accept them, do not use Gradeon.

2. What Gradeon does

Gradeon is a tool for managing trading card collections. It lets you:

Gradeon is an inventory and comparison tool. Gradeon does not buy, sell, ship, authenticate or appraise any card, and takes no part in any transaction.

Gradeon does not put users in contact with each other. The app has no messaging and passes on no contact details: no email address, no phone number, no postal address. Only your username is visible. Getting in touch and arranging a trade, if you want one, happen by means you choose yourself, outside Gradeon.

3. Your account

You agree to provide a valid email address, to keep your password confidential, and not to impersonate anyone. You are responsible for activity on your account.

The service is restricted to people aged 13 and over. If you are a minor, you must obtain permission from your parent or legal guardian, in particular before any card trade.

You can delete your account at any time from Profile › Delete my account. This deletion is permanent.

4. Prices are indicative

This is an essential point, and worth reading carefully.

Prices shown in Gradeon come from public third-party sources (notably TCGplayer and Cardmarket data relayed by pokemontcg.io) and are converted into your currency using exchange rates published by the European Central Bank.

As a result:

Do not base any purchase, sale or trade decision on the figures shown by Gradeon alone. Always check against the marketplaces and, where the stakes justify it, with a professional. We provide no investment advice, and trading cards are not a savings product.

5. Centering and grade estimates are indicative

Gradeon measures a card's centering from a photo and compares it against the grading scales that the grading companies publish themselves on their own websites. The results shown, including where they refer to a PSA, BGS or CGC style scale, are estimates computed by an algorithm from an image.

They are not an official grade, not an appraisal and not a certification. Only the grading companies themselves issue grades, after physically examining the card. Gradeon is not affiliated with, associated with, or endorsed by PSA, Beckett (BGS), CGC or any other grading company.

Their names are used only to identify the public scale a measurement is compared against, which would be meaningless without naming it. Gradeon uses neither their logos, nor their visual identity, nor any data they have not published themselves, and reproduces none of their documents.

The quality of an estimate depends on the quality of the photo. Centering is only one criterion among several in a real grade, which also accounts for corners, edges and surface.

6. Trades between users

What Gradeon does is limited to comparing two collections and indicating which trades would be possible, then, if you have reached an agreement, updating your two inventories inside the app.

Everything else is yours. Gradeon does not put you in contact, passes on no contact details, arranges nothing and tracks nothing. Getting in touch, negotiating, shipping and receiving take place entirely outside the app, by means you choose.

You acknowledge and accept that:

It is therefore up to you to choose the people you deal with carefully, to keep your own proof of shipment, and to confirm a trade only in full knowledge of the facts. In the event of a dispute, the users concerned must settle it between themselves; we may, without being obliged to, suspend an account reported for fraud.

7. Prohibited conduct

You must not use Gradeon to mislead others about the condition or authenticity of a card, to harass or pester another user, to extract the service's data en masse, to circumvent its security or access controls, or for any unlawful activity. We may suspend or delete an account in the event of a breach.

8. What you upload

You retain the rights to the photos you take. If you enable the contribution to improving recognition, you grant us the right to use the corresponding reduced images for the sole purpose of measuring and improving recognition and centering, for as long as your account exists. This setting can be turned off at any time. The details are in the privacy policy.

You agree to photograph only cards in your possession, and not to submit images containing people, documents or personal information.

9. Intellectual property and third-party trademarks

The app, its code, its visual identity and its name are our property.

The names, logos, artwork and content of the cards belong to their respective owners. Pokémon is a trademark of The Pokémon Company, Nintendo, Game Freak and Creatures. Panini is a trademark of Panini S.p.A. The other game, publisher and grading company names cited are the trademarks of their respective owners.

Gradeon is an independent collection management tool. It is not published, sponsored, endorsed by or affiliated with any of those owners.

These names and logos are used solely for identification and illustrative purposes: to let you recognise which card game is being referred to and to avoid any confusion between them. This use is strictly descriptive. It constitutes no commercial exploitation of those trademarks, suggests no partnership, and claims no rights over them. Any owner wishing a name or logo to be removed may write to us at the address given in clause 14: we will do so.

10. Service availability

Gradeon is provided "as is", without warranty of availability, of freedom from error, or of fitness for a particular purpose. The service depends on third-party providers and catalogues whose interruption or modification may degrade it.

The app is not a substitute for your own backup. We recommend you do not treat it as the only record of a valuable collection's inventory.

We may change, suspend or discontinue the service, informing you where reasonably possible.

11. Limitation of liability

To the extent permitted by law, we cannot be held liable for:

Nothing in these terms excludes the rights the law grants you as a consumer, nor our liability in the event of gross negligence or wilful misconduct.

12. Changes to these terms

These terms may be amended. The date of the last update appears at the top of the document, and any substantial change will be flagged in the app. Continuing to use Gradeon after such a change constitutes acceptance.

13. Governing law

These terms are governed by French law. Failing an amicable settlement, the French courts have jurisdiction, subject to the protective rules applicable to consumers residing in another European Union member state.
